What is HOA?

The abbreviation of HOA has the following decoding: a partnership of homeowners. Formation and direction of the activities of this legal entity is regulated in the Housing Code of the Russian Federation.

So what is HOA? This community of people - the owners of premises, which are located in the same house, consisting of many apartments. The purpose of this association is the management of the entire complex of real estate, which includes the house itself, as well as a plot of land and other facilities. When disclosing the concept of what a TSA is, you need to know the legal aspects of this legal entity, since it is such since its registration with the government.

Such an association, like all legal entities, has its own bank accounts and a seal. The organization of the HOA includes also tax accounting, and the exercise of the right to conclude various transactions, and the right to be a defendant and a plaintiff in court. Owners of premises in one house will be able to register only one HOA. At the same time, the issue of its formation is decided at the general meeting of the owners of the premises of the house and is adopted when voting "for" more than 50% of the owners.

One partnership for more than one house can be created in the following cases:

1. If several houses have more than two owners and are located on the same plot of land, or in the neighboring ones, on which engineering and technical support networks are located.

2. If there are several houses built by a family belonging to one family, with plots on common land or neighboring plots, or without them.

The management board of the HOA is represented by the members of the partnership who collect the general meeting in the manner prescribed in the charter.

Responsibilities of HOA

According to Article 138 of the RF LC, the HOAs have certain functions. We have clarified the question of what a TSA is, and now we will clarify the scope of its activities:

• conclusion of contracts for the maintenance and repair of property that is common, with the owners of the premises of a house that are not in the partnership;

• fulfillment of obligations under the contract provided for by law;

• ensuring the proper technical and sanitary condition of the property of the common house;

• ensuring that all owners of premises fulfill the obligations of maintaining and repairing property that is common, according to their shares in the ownership right;

• ensuring the observance of the rights and interests of the owners of the premises of the house when establishing the order of tenure, the conditions for the use of property that is common;

• taking measures to prevent or stop the actions of third parties that impede the exercise of the rights of use by the owners of the premises of the house to be common property;

• Representation of interests and protection of rights of owners of premises of the house, including in relations with third parties.

Advantages of HOA

Creation of HOA has certain positive aspects: it allows owners of premises of the house to realize the fullest realization of their rights to manage and dispose of property that is common. And it also provides an opportunity to make the scheme of receipts and spending of funds collected from owners and tenants of premises in this house more transparent and favors attraction of investments and improvement of living conditions.

If there are less than 20 apartments in the house where HOA is planned to be created, registration of the partnership will be unprofitable, since the owners of the premises will have to pay for the work of the chairman, accountant and other employees. Therefore, HOA is best to create in multi-family houses, where small expenses are not of great importance. The opinion of many specialists is that the HOA, promoting the creation of a higher level of organization of owners and control of performers, claims the title of the most productive form of self-management in the housing sphere of activity.
