The cadastral value is the cost of what? How to find out the cadastral value?

The cadastral value of real estate is the most important indicator from the point of view of the most diverse types of legal relations involving the citizens of the Russian Federation, authorities and organizations. Due to the high importance of the relevant characteristics, its definition is strictly regulated by law. What is the cadastral value of the property? How can I find out about the object of interest?

Determination of cadastral value

The cadastral value is the value of real estate, calculated and fixed by the state structure - Rosreestr. There is also a full name for this department, namely the Federal Cadastre and Cartography Service. The criteria by which Rosreestr determines the value of real estate, can be very different.

Now those are considered market indicators - those that reflect the specificity of pricing for real estate in the city or region, based on the mechanisms of supply and demand. The cadastral value of real estate today, therefore, can be as close as possible to the market value.

Specifics of cadastral valuation of land

There are certain features that characterize the inclusion in the record of Rosreestr information about land. Let's consider corresponding specificity.

The cadastral value of land is not its only possible characteristic. Along with this, there is still a market and regulatory price of the plots. In this case, the cadastral value is the value that is determined based on the land valuation taking into account its class, the current level of market prices, as well as the size of the lease rates. The main source of law governing the procedure for entering information on sites in the record of the Rosreestr is the Law "On Appraisal Activities".

The cadastral value of land is the category that is most important from the point of view of calculating the tax on the corresponding type of property. Its size is directly determined by the results of Rosreestr's actions. The procedure for cadastral valuation of the territory is also important for establishing the restrictions on the use of the relevant type of property, such as leasing or redemption, provided by law.

Regarding the land plot, the cadastral value is the cost, which is also formed, based on its area, the category of the zone in which it is located. The specificity of the relevant assessment is that it should be reviewed every 5 years. Rosreestr, thus, forms lists of sites that need a cadastral assessment.

What is the cadastral value used for?

For what purpose Rosreestr calculates and fixes buildings and structures in the corresponding records? The cadastral value of the property can, as we noted above, affect the amount of land tax, as well as the property tax that is levied by the state from the owners of apartments, houses and other objects. Legislation regulating the relevant type of collection in Russia, suggests that the numbers recorded in the record of Rosreestr will be exactly the same as the market ones. But such a norm was introduced only in 2015. Prior to this, the property tax was calculated based on its inventory value, as a rule, several times lower than the cadastral value .

The cadastral value of the property is an important criterion when selling the relevant objects. In what way is this expressed? In order to carry out a transaction for the sale of an apartment or house, it is necessary to issue a cadastral passport of the property. It is highly desirable that this document is fresh. The fact is that cadastral value is a value that can change periodically, based on adjustments in Rosreestr's records.

Specificity of calculating the tax on the basis of the cadastral value

We will study the basic information about the marked tax, which property owners must pay to the budget. Above we said that since 2015 cadastral value is a market valuation of real estate. Before the legislation was fixed, the real estate tax was calculated on the basis of its inventory value. It could be several times lower than the cadastral one. Therefore, deductions of the order of 0.1-0.3% from it, which citizens had to pay to the budget, were not too strong a financial burden.

However, the legislator decided that the basis for calculating the tax should not be an inventory, but a cadastral value. What is this innovation? In all likelihood, the relevant initiative was implemented by the authorities in order to increase budget revenues. At the same time, the formula for calculating the tax on the basis of cadastral value is still different from that used for inventory indicators.

So, there is not supposed a proportional increase in the financial burden on homeowners - despite the fact that the basis for calculating the tax in most cases increases by several times. This is possible due to, firstly, the statutory tax deductions, based on the type of real estate and its area, and secondly, due to the fact that until 2019 in the Russian Federation a transition period has been established from the old system of calculating fees to a new one, in determining the value Actual payments to the budget can be used to reduce the coefficients.

The tax formula in question is thus composed of three components:

- cadastral value of the object, close to the market;

- deduction determined on the basis of the type of real estate and its area;

- lowering coefficients.

At the same time, in absolute terms, the tax determined on the basis of the cadastral value of real estate is usually higher than in the case when the basis for calculating the fee is based on inventory indicators.

How do I find out the cadastral value of a property?

The cadastral value of an apartment is official information that is provided to citizens by Rosreestr. There are several ways in which you can get it in this department. The first option is to use online resources available for citizens on the agency's website. The second is to look at the current cadastral passport of the facility. There is a third option. It involves addressing directly to Rosreestr's structures working in a particular region. Let us study the mechanisms mentioned in more detail.

Working with the website of Rosreestr: an extract from the GKN

Firstly, it can be done by ordering an extract from the GKN. How to use this option? It is necessary to go to the main page of the website of Rosreestr, then go to the section associated with services for individuals. Then you need to select the service "Obtaining information from the GKN". After that, you must fill out the online form and send the relevant application to the Office. If the document is filled correctly, then upon sending it the system will issue a control number. It will need to be recorded - you can track it at what stage the application is at. The relevant information from the State Tax Committee, including the cadastral value of the object, the agency must provide the applicant within 5 days after receiving the documents.

Public cadastral map

Secondly, the citizen can receive the necessary information by using the interface of the "Public cadastral map", which is presented on the website of Rosreestr. How should I use the appropriate service? The cadastral value of real estate is a collection of information that is identified by a special number.

A citizen planning to use the service in question should know it. Having opened an online card, you must enter the cadastral number in the appropriate fields, after which the system should give the person information about the property of interest. However, the information displayed on the map can not be considered legally significant. It is of a reference nature.

Online directory

Thirdly, you can use the online service "Background Information" on the website of Rosreestr. If we are interested in the cadastral value of the object - this is also a perfectly acceptable option for obtaining it. This online service can be found in the section "Electronic services". As with the use of a card, it is desirable to know the cadastral number of the property. However, it may well turn out that there will be enough address of the building.

Data from the Data Foundation

There is another interesting variant of using resources of the site of Rosreestr. So, on the relevant portal there is a service with which you can obtain the information of interest from the Cadastre Valuation Data Foundation. Information flows there as a result of actions of regional or municipal authorities. In order to use this service, you need to enter the "Individuals" section, and then select an option that reflects the desire to receive data from the Fund. In this case, you will also need a cadastral number of the property. The service is convenient because with its help it is possible to generate and download a report reflecting how the cadastral value of the building was determined. This is very important information for many citizens.

Offline interaction with Rosreestr

If the required information on the site of Rosreestr was not found or it was not possible to use the marked services, then it is possible to apply to the department in the order, so to speak, of an offline request. To do this, you will need to go to the territorial office of Rosreestr or to the city MFC - one that has competence in the matter of providing information from the cadastral register. You can also send an appropriate request to the Office by mail. Many citizens believe that it is more convenient to learn such an option, as cadastral value, through offline, that this is the most optimal variant of interaction with Rosreestr. It can also be noted that the documents received in the order of offline interaction of the owner of real estate with the office are, as a rule, quite official and of legal significance.

When the numbers are too large

There can be situations when the corresponding figures, determined by Rosreestr in relation to the real estate object, are objectively higher than market ones, as a result of which the amount of tax that citizens pay to the budget also increases. The legislation of the Russian Federation that regulates Rosreestr's valuation activities provides for the protection of the interests of owners in such cases.

So, a citizen who believes that the cadastral value of the plot calculated by Rosreestr is an indicator that does not objectively reflect the state of affairs in the market, can defend its position in court or through interaction with the agency within the framework of the mechanisms established by law. In order to challenge the figures specified by Rosreestr, a citizen should bring documentary evidence. These can be:

- acts, which confirm the unreliability of the information recorded in the register;

- documents reflecting the market value of the property;

- expert opinions on the compliance of the law with mechanisms for determining the cost of housing, which are used by a citizen.

It is advisable to begin cooperation with Rostraestre on the correction of data related to cadastral valuation, within six months after the relevant information in the records of the department was updated. In the event that the costs associated with the preparation of the necessary documents that are aimed at refuting the figures from Rosreestr are tangible for the citizen, he is entitled to apply to the court for compensation of costs at the expense of the department.
