How to write a receipt on the transfer of money in debt

Every person needs a large amount of money from time to time. For example, when there is not enough for a vacation, appliances or even an apartment. Of course, you can take the missing money in the bank, but the loan will take a lot of time, and can refuse to issue at the last minute. In addition, you have to overpay, and in the case of major purchases, the bill can go to tens of thousands of rubles. Therefore, many prefer to take the missing amount from relatives or friends.

For a long time they have sunk into oblivion, if at all there have ever been times when they were given on parole. If your acquaintance or friend asked for money for a large loan, it is mandatory that you require a receipt from him and do not be afraid to offend him. Otherwise, you can lose both a friend and money.

How to correctly write a receipt is not an idle question. Only a well-written document can be a proof of the transfer of money and will be recognized by the court. In principle, there are no special requirements to the appearance of the document and the form of spelling. The receipt can be written in verses and on a scrap of paper, the main thing is its content. The only thing that is usually recommended is to write it by hand, rather than typing on the computer. In this case, if necessary, it is easier to prove the fact of the self-written receipt by the debtor.

Before you write a receipt, you need to make sure that the person to whom the money is issued has a valid passport. If the passport is not for some reason, there must be a document certifying the identity with the photograph. If the passport is there, but it is overdue, it is better to postpone the transaction and wait for the corresponding execution of the document.

How to write a receipt? The sample is approximate, but on its basis it is possible to compile a real document:

I, Ivanov Ivan Ivanovich, 10. 02. 1983 of birth (further - by whom and when the passport was issued, its number and series, address of registration and / or address of actual residence) borrowed Petrov Petrov Petrovich (indicate his passport data) 2000 rubles (the amount in words - two thousand rubles). I undertake to return a certain number (the date is indicated). If you agreed to repay the debt in installments - it should be indicated which part, in what amount should the debtor return. Below is the signature of the debtor, the transcript of the signature and the date of writing the receipt.

What moments should I take into account before writing a receipt? The document should not contain spaces between the lines. If any - it is worthwhile to cross out them, to exclude the possibility to enter additional information into empty spaces.

The receipt is written in two copies - one is transferred to the creditor, the other remains with the debtor.

Before writing a receipt it is worthwhile to invite independent witnesses, since the paper itself does not have legal force. It's better if it's people who are not interested. Otherwise, the court, if it comes to the proceedings, may not count their testimonies.

Before you write a receipt, you need to count the money in the presence of witnesses, sound the amount and transfer it from hand to hand. Witnesses in turn sign under the main text:

We (name, passport data, contact information) assure that this receipt was written by the Ivan Ivanov debtor (his contact information and passport data) and handed over to the creditor Petrov Petro Petrovich (passport data and contact information) after Ivanov Ivanovich was Transferred money (the amount in words) Petrov Petrov Petrovich, about what we personally sign (place, time and date, signature).

If it is a question of large amounts, it is better to apply to a notary for drawing up a loan agreement and verifying the receipt.

If desired, the text can specify penalties, fines and interest that the debtor must pay if the debt is not transferred in time. Of course, it is necessary to specify the amount and terms of payment of interest (for example, as a percentage of the original amount).
