How and where to get an absentee certificate. Voting by absentee ballots

On such a document as an absentee ballot certificate, if not all, many citizens of our country have heard. What is this document? Where to get an absentee certificate and in what cases can they refuse to extradite?

What is an absentee certificate?

To exercise the will, that is, "to vote" for one of the candidates in the election, according to the law, a citizen can only in one section of the election commission (IC) - where he is assigned, that is, included in the voter lists. In the event that the election participant does not have the opportunity to arrive on his IC site on the voting day, a citizen may receive an absentee certificate (DU), a document that gives him the right to vote once in any accessible polling station.

What does this document look like?

There is no single form of absentee ballot for all election activities. In accordance with the law, the form and text of this document, the form of the register and other is approved 60 days before the official voting day by the order of the CEC of the Russian Federation.

However, for all absentee ballots, a uniform form is legally established, followed by the issuance of this document. Thus, an absentee certificate must contain some information. Namely:

  • The name of the event (referendum or elections) held, for which absentee certificates are issued.
  • Name of the document and number (to be specified additionally).
  • Lines for filling in by a citizen who applied for an absentee certificate. This section is entered by the name. Participant of elections, information about the passport (the document replacing the passport).

  • A standard text certifying that a citizen receives an absentee certificate and his right to participate in election activities in any section that will be available to him on election day.

  • The lines for signing the election participant, the date of receipt of the Shelter.

Particular attention is paid to protecting this type of document from a possible forgery. When making a typographical form of the certificate, watermarks are applied to the surface, a protective net is covered, a microprint and other special protection elements.

For what reason can a citizen use the OS?

Voters who can not come to vote can receive OU for the following reasons:

  • The voter is away (leave, business trip, training, etc.), including abroad. In the latter case, an absentee certificate gives the right to vote on the territory of the Russian embassy.
  • The voter is in the place of temporary stay - he receives treatment in a medical organization, is under arrest and so on.
  • Voters are servicemen who are on duty on election day in units outside the permanent duty station.
  • Voters engaged in work, assuming continuous working conditions.

The law provides special conditions to students who have a temporary registration in the educational hostel. They have the right to participate in elections on the section of the IC, to which the place of their temporary residence refers. Receiving an op amp is not required. Similar conditions for temporary attachment to the polling stations are valid for some categories of voters, for example, conscript soldiers.

It is necessary to remember the following: the fact of extradition to a citizen of an OS is the basis for excluding an election participant from the list of voters at his territorial polling station. However, it is this document that gives the right to vote at any polling station, including its own territorial. In practice, this means that if the reason for obtaining the OS is no longer relevant, and the election participant arrived on the voting day at the polling station at his place of residence, the previously issued absentee certificate must be carried.

Do I need an op amp when moving to permanent residence?

It is often possible to meet such a question: if a citizen changes his permanent residence shortly before the voting, moving to the territory belonging to the lists of another IC, does he need to take care of receiving an absentee certificate in advance?

By registering at a new permanent place of residence, the future voter will be automatically included in the lists of the IC site at the new place of residence. If a participant has doubt, he can personally verify the availability of his data in the list for the new place of residence. To do this, it is enough to go with a passport (another identity card) to the district IC within no more than 20 days prior to the voting day and to clarify whether the citizen is included in the electoral lists on the new site.

Where to get the op amp?

The issuance of absentee certificates is handled by the election commission at the place of registration (registration). It is possible to apply for the OS to both the territorial election commission and the election commission on its site. It should be noted that the timing of receipt in the precinct election commissions and in the territorial election commissions is different.

How to find out the address and contacts of the territorial or district IC?

Addresses and contact details of the precinct and territorial election commissions, election participants can learn from several sources:

  • Lists of IC sites after approval by their head of the city (municipal district) are published in the press together with regulatory acts and laws of local self-government.
  • On the official website of the regional election commission or the site of the city administration (municipal district).
  • From information leaflets (invitations to elections), which are sent to all voters at home.

Timeframes for obtaining an op amp

The receipt of the absentee certificate is limited only by the deadlines. To declare their desire to participate in elections at another polling station and receive the document the citizen is required in advance. What are the deadlines for obtaining the Shelter?

From 45 to 20 days before the announced voting day, the document can be obtained from the territorial election commission. The district ICs start issuing to citizens of the Shelter within a period of 19 days prior to the beginning of the elections and finish 24 hours before the voting.

Why is it so important to get the OS in these terms? Immediately prior to the beginning of voting, absentee ballots are officially paid at all polling stations. That is, the destruction of all unclaimed forms of this document.

Documents for obtaining an OS

To obtain an OS, a citizen will need to report to a territorial or district IC with a passport (another document replacing him) and write an application for an absentee certificate. It is not required to present other documents, including those confirming the reason for obtaining the Shelter.

The citizen can apply by filling out a special form or by writing an application on a standard sheet by hand, but with all the requirements of the application form.

If a citizen can not personally declare the receipt of the Shelter, for him it can be done by a trustee, for example, someone from relatives. To do this, it will be necessary to formalize a notarial power of attorney to the representative. Instead of a notary in the case when the voter is in places of temporary stay, the power of attorney can be certified by the head (administration) of the organization of stay - the chief doctor, the head of the SIZO, etc.

In the application, the voter (representative by proxy) will be obliged to indicate the following:

  • In the upper right corner - the name and number of the election commission, where the citizen (his representative) applied for extradition.
  • FULL NAME. And place of registration of the applicant.
  • Regardless of whether the application is written by hand or filled in on the template, it is necessary to indicate the reason why a citizen can not arrive at the polling station on election day.
  • Please give an absentee ballot personally to the applicant (his authorized representative) to participate in the voting.
  • Signature and date of compilation and submission of the application.

What information is required in the OS?

What information should I specify and how correctly to fill out the absentee certificate? (The sample is presented in the article.) The form of the absentee certificate is filled in person by hand. The following information should be indicated in the OU lines:

  • Full name of the name and patronymic of the election participant.
  • Information about the passport (other document proving the identity).
  • The number and address of your territorial polling station.

Further, the absentee certificate is filled in by the chairman or the member of the EC who certifies the document with his signature and the seal of the IR.

The OS is lost - can you get a duplicate?

Regardless of the type of government in which elections are held, an absentee certificate can be obtained only once. In case of loss (damage), the issuance of a duplicate of this document by law is not provided.

How to vote on the OS?

How is the absentee ballot certificate received by a citizen used in elections? The voting procedure for this type of document is as follows:

  • In the day appointed by law, a citizen must appear at the polling station he has chosen, having a passport (replacing his document) and an absentee certificate.
  • The DU is presented to the responsible member of the election commission, on the basis of this document, the election participant is additionally included in the voter list.
  • A note is made that the citizen participates in the selective events on the absentee certificate.
  • An absentee certificate (or a voucher, if present in this form) is withdrawn from the election participant by a member of the commission.
  • Further voting is conducted by the citizen in the usual way.

Alternative TO - voting outside the site

Voting on absentee certificates is often confused with another procedure provided for by electoral law, allowing to participate in voting without personal presence at its polling station. It is a question of voting outside the site, that is, the delivery of the ballot box to the house or other place of stay of the citizen. Legislators emphasize: it is impossible to apply simultaneously for voting outside the site and issuing the OS, in fact, these ways of expression of will exclude each other. The delivery of a ballot box to a citizen is possible only from the IC, whose lists are included as a voter at the place of registration, while the OS excludes a citizen from these lists.

Do not issue an absentee certificate - what should I do?

The voter can not refuse to receive an absentee ballot in the election commission or to prohibit taking part in voting on the OS in the appointed election day.

As a rule, violations in the issuance of this document occur relatively infrequently. But if the right of a voter to receive an absentee certificate is violated, what can be done in this case?

  1. Write a complaint to the head of the territorial election commission of the city (municipal district). It is necessary to specify in detail the circumstances of the violation of electoral rights, the data (the name and position) of the member of the IC who refused to extradite the OU to the voter. The complaint can be submitted to the secretary of the IC for signature on the second copy, or sent to the territorial IC by registered mail. Also on the official website of the electoral committee provides an opportunity to leave a complaint online.
  2. If the complaint is not properly responded, you can apply to the regional (regional) IR. In addition, it makes sense to apply to the site "Golos" - a public movement monitoring violations during elections.
