Head of the city: rights and duties. Elections of the head of the city

The normal functioning of all the systems of the settlement, competent and timely fulfillment of the assigned tasks in the field of economic, social and other areas of development is impossible without the control of the head of the city. But how can voters assess the quality of this person's work? In accordance with his duties and powers, which will be discussed in this article.

Mayor of the city: the meaning of the concept

The head of the city is a person occupying the highest position in the settlement and endowed with powers under the Federal Law, enshrined in the Constitution of 06.10.2003. Another name for this post is the mayor, or the head of the municipal formation.

The head of the city administration is entitled to solve problems and deal with the settlement of conflicts at the local level.

It is noteworthy that in different countries this post is called in its own way. So, for example, in Poland the mayor is usually called a burmistre, in Bulgaria - by a comet, and in Scotland by a lord-provost, etc.

Requirements for the mayor

In accordance with the legislation of the Russian Federation, not every citizen can receive the post of the head of the city. To qualify for this responsible post, a resident of our country must necessarily have Russian citizenship, that is, be registered on the territory of the state. There is one more condition: a person who has not reached the age of 21 can not become the mayor of a settlement.

One of the unspoken rules is a good reputation of the candidate, which increases his chances of trust on the part of residents, in favor of which decisions will be made and various legislative acts. The future head of the city should also not be held criminally liable. This also applies to an impeccable reputation.

Powers of the city head

The mayor performs a variety of managerial functions. For example, the head of the city promotes the adoption of various legal acts and regulations. He is also a representative of the settlement under his control in meetings with regional authorities, legislative assemblies and other business meetings. The mayor has the right to approve and sign various documents adopted by the Council of Deputies of the municipality . The head of administration, within the limits of his powers, can also draw up normative acts, which include orders and decisions.

The post in question obliges the mayor to be accountable to the Council of People's Deputies. It is to the court of this legislative body that the mayor presents the drafts of various programs for the development of the municipal formation, and also proposes to introduce changes in the amount of local taxes.

The mayor has the right, at his own discretion, to fire or hire his deputies, city administration heads. The range of powers of the mayor includes drafting orders on the creation, elimination and reorganization of municipal institutions.

The duties of the head of the city are very diverse, and, since it is under the control of all departments of the settlement, he has the right to verify their work.

Elections of the mayor

The elections of the head of the city are carried out, in accordance with the charter of this municipal formation, in accordance with the laws of the Russian Federation. There are two most common types of this procedure.

The first type is a secret ballot on the basis of equal suffrage. All residents of the city can participate in it, except for those who have not reached the required age. The second type is a vote among the members of the local administration and other governing bodies of the municipality. It should be noted that the last type of elections is characteristic mainly for rural areas, where there is no need to draw a line between the functions of the head of administration and the representative body.

Increasingly popular is the system, in which the mayor is just a nominal figure that does not have actual power. In this situation, the head of the administration, as well as the representative body , are engaged in making decisions concerning the municipality .

The difference between the functions of the city manager and the head of the city

The functions of the head of the city were described above. Now more about the work of the city manager. In Russia, this position has not yet become widespread. In many cities there are still no clearly established criteria for the election of a person for this position.

City Manager is a professional manager who performs tasks assigned by the city administration. Its goal is to work as quickly and rationally as possible, to do everything for the good of the economy and the economy of the municipal formation, to improve the quality of life of the population through the demolition of dilapidated housing, the development of projects for the construction of hospitals and kindergartens, repair of roads,

One of the chairpersons of the regional Public Chamber sees difficulties in introducing the post of city manager in the management apparatus due to the lack of necessary reforms. So, it is planned to reorganize the powers between the authorities of different levels: local, regional and federal. There was also no horizontal reform that would make it possible to distinguish between the functions of the head of the city, the Duma and the city manager. Only after all these changes will it be possible to introduce this post into the administration of the municipality .

Termination of powers of the mayor

Sooner or later the term ends, during which a person held the post of mayor. His powers cease when a new head of the city is elected to this post. However, early termination is possible in the following cases.

First, the mayor can resign at his own request even before the expiry of the term for which he was elected. Secondly, the decision on the resignation of the incumbent head of the city is taken by the court if the official is found incompetent, partially incapacitated for health reasons, missing or deceased.

Thirdly, the mayor's post is incompatible with the change in the citizenship of the Russian Federation for any other, and also with the transfer to another country for permanent residence.

The post does not relieve the head of the municipal formation from military or alternative civilian service, therefore his powers cease if he receives, for example, a summons from the military commissariat.

The term "city head"

The word "mayor" is borrowed from English and means "main". However, in the Russian Empire the post of head of the city was called in a different way. The first person in the settlement was called the city's head and was elected for three years. This post was established in the second half of the XVIII century by Catherine II.
