What determines the duties of the bailiff?

The duties of the bailiff are established by the job description at the duty station, but it should be based on the legislation of the Russian Federation, primarily on federal law number 118, adopted in 1997, on July 21 ("On bailiffs"). Here it is immediately worth noting that the normative act identifies two types of bailiffs: employees who provide the activity of courts and bailiffs-executors.

They also have the right to visit, dissect premises or storehouses (subject to appropriate regulations), the right to seize property and other valuables of the debtor, including money held in accounts with credit institutions.

The official duties of the bailiff allow him to declare the search for property, the child, use non-residential premises for the non-permanent storage of the received property, check the documents of this or that person, commit other actions from the sphere of enforcement proceedings established by law. A bailiff must be an impartial person, otherwise he must withdraw. Chapter 15 of the above-mentioned law establishes the conditions and limits for the use of special means, physical force or weapons. In accordance with it, the duty of the employee is to warn the other side about the intention to use them, minimize damage and provide medical care to the injured.

Official duties here also indicate that the employee must keep state secrets and not disclose information about the private life, dignity and honor of citizens about whom any data were received. The work of the bailiff is rather difficult, since it is necessary to find the persons indicated in the regulations, conduct explanatory talks with them about the fulfillment of obligations, and in some cases "take with the fight" premises, describe the property, which is unpleasant from a psychological point of view, and Sometimes even on the part of physical health.
