Is there a person who did not come to work at least once? Hardly. Quite a few also those who hired employees themselves, so that almost everyone participated in labor relations - one of the most regulated spheres of civil turnover, primarily aimed at ensuring the labor rights of citizens. And one of the main directions here is the approved norms of working time.

Working time is an indispensable condition of an employment contract

How often does an average citizen think about how many average working days a month? Hardly, however, this indicator becomes very important, as soon as the labor contract is concluded.

The relationship between the employer and the employee is regulated by the codified normative act - the Labor Code. It lists all the important terms of the employment agreement, the modification of which is allowed only with the observance of a certain procedure or by mutual agreement of the parties:

  • Wages, size, terms of payment;
  • Working time, beginning and end of the working day, how many working days a month;
  • Periods, duration and grounds of rest;
  • Content of labor functions;
  • Guarantee measures and compensation payments.

These conditions must be observed by the employer in the form prescribed by law. When applying for work, the parties must reach agreement on the main points of the employment contract. At the same time, they can expand the rights of the employee, but they do not have the right to go beyond the limits of legally approved norms or to reduce guarantees.

One of the most important variables affecting the calculations between the parties is working time: on how many working days in a month, depend on the accruals, deductions and the amount of labor remuneration of the employee.

Why is labor standardization necessary?

Labor standards relate, in particular, to working hours and are regulated at the state level. Their observance is mandatory for all employers not only state but also private.

The Labor Code establishes the duration of the work week at 40 hours - this is a mandatory value for a five-day period. It is easy to calculate that the working day will be 8 hours. The workday can be shorter, then the duration of the week decreases. Such manipulations are permitted by law, in contrast to the increase in the fixed duration of the work week.

Types of working time norms

Above was given the main length of the workday, while the legislator provides for other options for working hours:

  • Shortened;
  • Incomplete;
  • The duration of night work;
  • A time limit for certain categories of workers: minors, women with children, persons with disabilities and others.

The application of these or other norms is connected with the circumstances stipulated by the legislation. This is stipulated in the contract or fixed by order: for example, an incomplete time is necessarily given to a woman who has a child under 14 years of age, according to her application.

Modes of work: what they are

During the working time, the employee is required to perform the functions prescribed to him and comply with the internal regulations, that is why the definition of the beginning and end of the working day is so important in the employment relationship.

The working time mode can be connected:

  • With the number of working days a week - five or six days;
  • With the schedule of work - fixed, flexible, replaceable;
  • With a period of shift - day, night.

With non-standard operating modes, it is important to correctly calculate how many working days in a month. To this end, the relevant ministry establishes the procedure for calculating labor standards, which focuses on different time periods. This procedure is registered with the Ministry of Justice and has the power of a full-fledged normative act, which employees of financial and personnel services can follow when calculating working hours.

How many working days per month? We make the calculation correctly

For the convenience of calculating working hours, in practice, so-called production calendars are used. They are popular with accountants and other financial service workers; Useful for such a calendar and staff staff.

With the help of the production calendar, it is not only convenient to calculate the working days in a month, but also to quickly track other significant statistics, depending on the duration of the working week.

The production calendar contains the following data, distributed monthly:

However, the calculation must be adjusted taking into account holidays and non-working days, as well as reduced pre-holiday everyday life.

Legislation establishes that if the holiday coincides with the employee's day off - Saturday or Sunday, then it is postponed to the next business day, thus adding an extra day off.

For example, if January 1 falls on a Sunday, then on January 2, Monday will be a day off. These moments are taken into account when calculating the number of working days separately for each year.

Is overwork time permissible?

Current regulations allow you to easily calculate how much in a month of working days, and therefore, and comply with the established requirements for the employment of staff.

However, production is not always predictable, and managers sometimes have to find non-standard solutions to current issues. Such exceptional cases can become the basis for forced work of staff on weekends or exceeding working hours, whereas according to the basic rule such actions are prohibited by law.

Responsibility of the employer for exceeding the norms

The normalization of working hours is fixed at the state level and the maximum duration of labor is an indispensable and invariable condition of the labor agreement between the employer and the employee. This approach is one of the guarantees for protecting the rights of hired personnel to safe working conditions, decent and fair remuneration, the necessary rest and other requirements of labor legislation.

Violation of the norms of labor legislation is the basis for attracting the employer to liability, including for non-compliance with working hours. Supervisory authorities can recognize the failure of the labor law the most diverse violations associated with the calculation of working hours:

  • Exceeding the duration established by law;
  • Groundless conclusion to work on a day off;
  • Unauthorized recruitment for overtime work;
  • Incorrect calculation of workdays and other cases.

Under such conditions, the employer must keep an eye on the pulse and closely monitor the correct accounting of working hours. For this it is important not only to comply with the requirements of labor legislation, but also to have information on how many by the standards the number of working days in a month or year, the number of official holidays, the duration of pre-holiday days.
