A stateless person

The legal status of stateless persons and foreign citizens in the Russian Federation. The right of asylum. These issues will be discussed in the article.

A citizen of another country or a stateless person is undoubtedly endowed with all human rights and freedoms while on the territory of the Russian Federation, they have common duties to the Russian Federation, but their rights do not include rights belonging exclusively to Russian citizens.

Foreigners and stateless persons in the presence of a visa or other necessary and valid documents with the help of which it is possible to verify their identity, recognized on the territory of the Russian Federation as a foreigner certifying the identity, may be located in the Russian Federation.

Sometimes foreign citizens and stateless persons do not have the right to be on the territory of the Russian Federation without a residence permit (the document is issued to the above-mentioned categories of citizens and stateless persons in order to verify their identity, and confirm their right of free exit and entry into the territory of the Russian Federation).

Having applied to the competent authorities of the Russian Federation with a petition, a stateless person can obtain a residence permit.

After the document is received, a citizen of a foreign country or a stateless person acquires the right to leave the territory of Russia and the right to return to the territory when providing an identity document, as well as recognized by Russia in this capacity.

There are some cases when a residence permit is not provided for a number of reasons.

1. For example, when a foreigner or stateless person by his stay on the territory of the Russian Federation can damage her defenses or security. Either threatens public order. Or it can cause danger to the life or health of the population of the Russian Federation.

2. The residence permit for those persons who were previously deported from the Russian Federation is not granted.

3. If the applicant does not pay the conviction under an article that is considered to be grave or especially grievous in the Russian Federation.

4. A citizen of another country or a stateless person applying for a visa is not in a position to confirm the availability of sufficient funds for living in the Russian Federation for the entire period of his stay in the country and for the subsequent departure from the Russian Federation.

5. If the competent authorities have made a decision on the undesirability of finding a person in the territory of Russia.

Expulsion of a citizen from the Russian Federation (deportation) is allowed as a response, administrative measure in those cases when this person committed punishable acts in the territory of the Russian Federation.

The deportee is obliged to leave the Russian Federation immediately after the competent authorities take the appropriate decision within twenty-four hours.

The Russian Federation provides political asylum for certain categories of persons.

A refugee can get a citizen of another state or stateless person if in the country of permanent residence he is threatened with persecution for sociopolitical activities or beliefs that correspond to norms and principles recognized by the world community.

Those categories of people who preach racial or ethnic hatred and intolerance, inhuman attitudes or ideas of the superiority of certain groups of people over others can not claim political asylum.

Citizens who have become political asylum or stateless persons simultaneously become carriers of all freedoms and holders of all rights, as well as of all duties of a citizen of the Russian Federation. In addition to those cases when federal laws or international obligations of the Russian Federation do not provide otherwise.

In order to receive asylum, it is necessary to submit an application and receive confirmation in the form of a presidential decree. The decree comes into force from the moment of signing.
