Obtaining a building permit: list of documents and exceptions

Building your own home is the dream of every person. Get a big family, have your own garden, garden and greenhouses, and maybe even decorate the yard with sculptures and fountains in the spirit of luxury. However, if before, in the pre-revolutionary times, there was no need for special permits or technical documentation, today the receipt of a building permit obliges citizens of the Russian Federation to collect the necessary package of documents. That is, in order to build your own house or at least make adjustments to your own, already finished, structure (after years after construction), the owner must undergo a number of procedures. Permission gives the right to make adjustments to the building, erect from scratch, this is a document that acts as a testimony that your project meets state requirements.

Who issues such permits?

If you do not plan to restore the facilities that are of historical value, the building permit will be obtained at the place of registration of the land plot. According to Article 8 of the Civil Code of the Russian Federation, such documents have the right to issue control bodies of settlements, districts, cities, etc. If the land is located in inter-settlement areas, then it is necessary to apply to the municipal administration.

What documents are required to obtain a building permit

Depending on whether you are a subject of entrepreneurial activity and whether you plan to build buildings for sale, or you have your own land and want to build a house for yourself there, the package of documents necessary to obtain permission for such actions is changed. So, in the first case, the package will include documents confirming registration in the state register, as well as in the tax inspection at the place of residence. At the same time obtaining a building permit (the process itself) will last at least two months. In the second case it is necessary to issue a statement indicating the exact address of the land, provide a certificate in the package that the land belongs to you, as well as the cadastral plan of the land (all in photocopies). Do not forget to attach to these documents a sale contract, photocopies of the passport, a certificate from the police that there are no convictions. Also in the list of documents for obtaining a building permit include permits from local gas, telecommunications and electrical networks, and the building itself.

Exceptions, that is, when documents are not needed

1. There is no need for permission to erect kiosks and other light structures that are not fixed by legislation as capital objects.

2. If you want to build a garage on your territory that is not an object of business activity, then you will also not need to obtain a building permit. In addition, you have the right to build a garage in the territory of gardening or giving.

3. If you are planning to build a sauna, a barn, a greenhouse, a summer kitchen on your site, you will not need permission.

4. No permit is required to make adjustments and changes to buildings, if they do not reduce their reliability, and also meet the established parameters for construction and reconstruction.
