What causes bribery?

Bribery was and, perhaps, will always be. What is giving bribes? The Criminal Code of the Russian Federation classifies it as a crime. It is a crime, not a misdemeanor. Is it serious? Yes seriously. For many, giving a bribe seems like something harmless. In fact, everything is not so. The harm caused by this act to society is great. Many segments of the population suffer from it.

The Criminal Code provides for her serious punishment. And what is a bribe? As a matter of fact, it is some kind of unofficial payment that is offered to the official for performing any actions. What do they ask him to do in this way? The request can be completely innocuous (for example, consider someone's candidacy for a position in the first place), but it can be connected even with violation of official authority.

Bribing a civil servant is a manifestation of corruption. A bribe to the employee of a commercial structure is commercial bribery.

Today, such crimes are more and more difficult to reveal. Difficulties are due to the fact that there are always some new ways of transferring money. Personal meeting is optional.

Often, funds are sent to an electronic wallet or bank account, can be transferred to a dummy company account, transferred to the account of a relative of the recipient of a bribe and so on.

Until 2011, this act was punished with a fine, the amount of which was equal to the amount of the bribe itself. Today, this penalty has become much more. This is not surprising, since corruption is a big problem of society. Criminal liability is prescribed in the Criminal Code. Specifically, in Article 291. Only a person of legal capacity who is over sixteen years old can be recognized as giving a bribe. An official may be not only domestic, but also foreign.

A small bribe is punished:

- a fine, the amount of which may exceed the bribe amount by thirty times;

- deprivation of liberty. Term - up to two years. This type of punishment is often appointed together with a tenfold fine.

Bribery in large amounts is punishable:

- a fine of a maximum of forty times the size;

- deprivation of liberty. The maximum period is three years. In this case, as a rule, a person is fined fifteenfold.

The bribe giving, which was made in order for an official to commit an illegal omission or act, is punishable:

- a fine that can reach a 60-fold bribe;

- deprivation of liberty. The maximum period is eight years. The fine can be up to thirty times the bribe size.

The description above applies only to the official who could really calculate the consequences of what is happening.

The bribe is punishable by collusion:

- a fine, the size of which can reach ninety-fold bribes;

- imprisonment up to twelve years. In this case, a fine of seventy times the amount of the bribe may be imposed.

When can a bribe be arrested? Acceptance by an official of at least part of the values - the moment of the end of the crime. The finished act will be considered and if the values are taken by one of his relatives or relatives.

25 thousand rubles - a significant amount of bribes, 150 thousand rubles - a large size.

In some cases, the bribe-taker helps to uncover or at least investigate a crime. At the same time, his release from criminal liability is possible . It is also possible if the official required a monetary reward, using certain threats (provided that the bribe-taker voluntarily confessed to the offense).

Bribery is not accidental punishable severely. Such measures are necessary. The bureaucratic apparatus is far from perfect. It is almost impossible to adjust its work, however, tough measures can give a good result.
