Changes in traffic rules: dangerous driving

Since June 2016, the traffic regulations have been amended, dealing mainly with those drivers who prefer "aggressive" driving. Innovations were introduced only in paragraph 2.7 of the rules, which states that the person behind the wheel is prohibited from doing certain actions and is now supplemented by a term such as "dangerous driving". The estimated fine here will be five thousand rubles. But, despite the innovations in the traffic regulations, the amendments to the Code of Administrative Offenses have not yet been introduced. Therefore, the responsibility for such an offense, as "dangerous driving", is still in question.

Definition

What is a dangerous ride and what is it expressed in? What rules should the driver violate in order to be punished for this?

A dangerous ride is expressed in the repeated performance by the driver of one or more actions occurring one after another, which consist in the following:

  • Non-fulfillment of the requirement to "give way" to transport having the advantage;
  • Rebuilding while driving, when all the bands are busy, except when you want to get around the obstacle, turn left / right or make a stop;
  • Non-observance of a safe distance before moving in front of transport, and also lateral interval;
  • Sudden braking, unless, of course, it was done to avoid an accident;
  • Preventing overtaking.

Especially if it creates a risk of death or injury to people, damage to cargo, cars, as well as other material damage. Only in this case, such driving can be called dangerous.

Here it should be noted that this definition is quite large and includes the violation of several points of traffic rules. It is for this reason that legislators decided to introduce such a definition as "dangerous driving".

How will the violation be fixed?

Of course, no inspector of the DPS can immediately identify all the violators of traffic rules. Therefore, special technical devices such as outdoor video surveillance cameras and other devices installed in the police cars will come to their aid, which will identify dangerous and aggressive participants in the movement. Also in the traffic police are hoping for the consciousness of other drivers who, if necessary, will be able to provide records from car recorders.

Alleged punishment

The responsibility for aggressive driving, such as dangerous driving (SDA), does not establish a government decree - it only fixes a new definition in the rules of the traffic. In addition, the Code of Administrative Offenses of the Russian Federation also does not provide for any offense for this offense. This issue is still under consideration in the State Duma. As planned, the possible fine here will vary within the limits of five thousand rubles.

Why was it necessary to introduce such a term as "dangerous driving" (SDA)? Government decision as the main document that fixes this definition, does not contain a specific answer to this question. Nevertheless, lawmakers believe that with the introduction of this notion, aggressive motorists will not so crawl on the roads and create serious obstacles to traffic.

Existing sanctions

Such an innovation as a dangerous driving, the SDA defines as a repeatedly committed one or more actions by the driver, which consists in not giving advantage to another transport, preventing overtaking, non-observance of a safe distance and lateral interval when there is a real threat of people's death and injury, or damage to goods, Damage. Nevertheless, the punishment for such behavior on the road in the Code of Administrative Offenses of the Russian Federation has not yet been fixed.

At present, this collection of laws contains sanctions only for certain offenses, which collectively create the term "dangerous driving". A fine for it is planned to be made within five thousand rubles. In the meantime, the driver can be punished for aggressive driving only by different articles of the current Code of Administrative Offenses. The sanctions here are as follows:

  • A sharp depression of the brake pedal - 1,500 rubles;
  • Obstruction of overtaking - the same amount as for the first violation;
  • Not to give way to another transport - 500 rubles or a warning (for the first time);
  • Rebuilding with strong traffic, as well as non-observance of the interval and distance - 1,500 rubles for each violation.

Conditions

The driver must make several violations of the traffic rules at once, so that he can be held accountable for the aggressive management of transport. For example, to make several changes at once with intensive traffic, when all the bands are occupied, or to prevent overtaking and to brake sharply in front of another car. In order for such actions of the driver to be recognized as aggressive driving, they must create a danger in which people are likely to die, damage to other machinery and cargo.

Characteristics and example

A term such as "dangerous driving" appeared in the rules of the traffic in order to stop the drivers who, by their driving style, pose a serious danger on the roads for other citizens. In particular, young people on expensive foreign cars make risky maneuvers, not thinking at that moment about other motorists and pedestrians. A few rash actions, such as non-observance of distance, rebuilding with strong movement, sudden braking without good reasons, are directly related to such a concept as dangerous driving (SDA). An example here is the following: a citizen for a few hours was driving his car around the city at a speed of about 200 km / h. At the same time he braked abruptly, unexpectedly rebuilt in a different row precisely at the moment when the traffic was particularly intense, and also did not observe Distance. As a result, this driver at full speed drove into the rear bumper of the bus, as a result of which passengers suffered.

Special titles

Each rash action of the driver, which is part of the definition of "dangerous driving", has its own name. Here, for example, are some of them:

  • "Checkers" (rebuilding with a strong traffic, when all the bands are busy);
  • "Nervous" (aggressive motorists, creating various obstacles to other drivers);
  • "Hurry" (when some participants in the movement do not observe the required distance);
  • "Educators" (sharp ungrounded braking before other transport);
  • "Beds" - the driver does not observe the lateral interval;
  • "Stubborn" - prevent the overtaking.

It should also be noted that such unreasonable actions of the participants in the movement lead to irreparable consequences. Hundreds and even thousands of people continue to die on the roads. And despite the fact that the law enshrined such a notion as "dangerous driving" (SDA). The article of the Code of Administrative Offenses, which would contain the form of punishment for such an offense, is still not provided for. For this reason, it can not be said that this innovation is effective and effective.

Important

Although a new definition appeared in the Traffic Rules, for the majority of drivers who drive with all the traffic rules, nothing has changed. This innovation is intended mainly for those citizens who do not respect other motorists and pedestrians, and also in their driving style pose a threat to the lives of others and damage to others' property. How this rule will be applied in practice is currently unknown. Therefore, a prepared bill on imposing a fine for aggressive driving is left until the fall. Because the punishment that MPs want to introduce may not be effective in fighting road workers.

In addition, it should be noted that the Code of Administrative Offenses already has sanctions for certain types of offenses that are part of such a concept as dangerous driving.
