Article 214 of the Labor Code of the Russian Federation. Obligations of the employee in the field of labor protection: basic requirements

In our society, it has become a tradition to always expose employers and entrepreneurs guilty. With the phrase "labor protection and safety" many will think that this term does not apply and does not apply to a simple worker, that this is a direct duty of the employer only. But from the legal point of view, this is not the case. There are duties of the employee in the field of labor protection.

Art. 214 of the LC RF

For each category, depending on the position held, the order and rules of medical examinations are prescribed in the job description.

The main duties of the employee in the field of labor protection also include training and increasing competence in this area. For example, the driver of heavy vehicles should increase their professionalism and develop safe working methods. This also includes the passage of mandatory instruction on the provision of the first necessary (emergency) care in children's and other organizations.

The first duty of the employee in the field of labor protection

It consists in passing all the examinations, if required by official duties. This is due not only to professional suitability. From this, the life and health of others, including children, can depend. An employer has the right to remove an employee who has not passed a medical examination on time before it passes. At the same time wages are not paid to the offender. In addition, suspension suspends work experience and affects leave.

However, these sanctions do not apply to workers who do not undergo a medical examination through no fault of their own. In this case, such employee for a period of forced downtime is paid wages and work experience.

If an accident, an accident, a catastrophe or a threat to the safety of the life and health of others occur, the employer has the right to dismiss him in accordance with the labor code if the fault of the violator of labor protection requirements occurs.

Training of workers in the field of labor protection

It must be carried out under the supervision of the head. These include:

  • Theoretical trainings and practical training on the elimination of accidents and emergency situations.
  • Internal briefings on safety at enterprises.
  • Self-training and more.

As for the last point, it is the most important. It is impossible to teach an employee if he does not make any effort. It is important that everyone in the team not only knew the duties of the employee in the field of labor protection, but also understood the entire responsibility for violation of safety procedures. After all, not only the safety of the employee, but also colleagues, surrounding citizens, children depends on observing the norms and conditions of work. A lot depends on the employer, but not all.

The list of responsibilities of business managers includes many items:

  • Safety at work;
  • Provision of protective equipment and means of collective protection;
  • The adoption of emergency measures to eliminate the consequences of accidents and disasters;
  • Organization of educational courses and trainings for employees in order to increase their competence in terms of labor safety;
  • Informing employees about the status of work conditions, existing risks associated with certain professional activities;
  • Ensuring the investigation in accordance with the legislation on violations of safety measures by the employees of the enterprise.

But these and other measures on the part of the management will not bring the expected results, if the employees themselves ignore the rules, do not comply with safety techniques and deliberately put at risk the life and health of themselves and those around them. Before you ignore basic safety rules and do not wear protective gloves, goggles or a robe, you must remember that all safety requirements are written with human blood. No matter how terrible it may sound.
