Change of the guaranteeing supplier of the electric power

This procedure is conducted publicly. Information on the change of the supplier is published in the local print media, it is located in the points for accepting payments, on the Internet (including on portals of branch departments, and also their regional representations). When changing the guaranteeing supplier, consumers-legal entities must conclude contracts with a new SOE. As for citizens, for them only the payment details are changed. Consequences for the consumer when moving to another supply company

In the event of a change of SOE, the consumer-legal entity must conclude a new contract within two months. It is enough for citizens to pay for the delivery of new requisites. It is necessary to take into account that payment starts from the moment when the consumer became aware of a change in the SOE. Even if an agreement with a new supplier is finalized later, it will contain a condition for payments for consumption from the date of transition to a new GP. Transition from the guaranteeing supplier to the sales company is carried out at the request of the consumer. One should take into account one nuance. If the supply company does not purchase electricity on the retail or wholesale market, it can only buy it from the GP.

The relationship of the guaranteeing supplier with the HOA and the management companies

GP, acting as a subject of the retail market, sells CC and TSZ electricity under a supply, purchase and sale contract, according to the Market Rules. The purchase is measured by an accounting device located on the border of the networks of the house and the service company. Separately, energy consumption is taken into account for common house needs and supplies to owners of non-residential premises. Payment by citizens is made at tariffs established for the population. Payments for the remaining amounts are calculated at the rates provided for the relevant legal entities.

Features of the contract

The agreement on supply / purchase / sale of capacity / electricity is in written (simple) form, unless otherwise stipulated by the Rules approved by Government Decree No. 442. The guaranteeing supplier needs to develop contract forms in accordance with the categories of prices or consumers, according to which tariff differentiation is carried out . If it is necessary to amend the Rules approved by Resolution No. 442, which entail the correction of the forms of contracts, the SOE must make adjustments to the agreement forms within a month (from the effective date of the relevant amendments). Responsibility of the guaranteeing electricity supplier

It is provided for in the Civil Code and the Rules (OPFRR) approved by the Government Decision No. 442. The supplier's liability is civil in nature. However, given the specific nature of the GP status, the company can be brought to administrative responsibility. Normative acts provide for 2 grounds on which the supplier may be sanctioned. Responsibility can occur for:

  1. Unreliable electricity supply and improper quality.
  2. Unjustified introduction of restrictions on the consumption regime.

Under the terms of the contract, the guaranteeing supplier is responsible to the buyer (consumer) for improper performance or failure to fulfill obligations under the agreement. He is responsible not only for the quality of his work, but also for the actions of the network company and other persons involved in the provision of electricity transmission services, which are an integral part of the delivery process.

The guaranteeing supplier may refuse to conclude an energy supply contract with the consumer if it does not have the opportunity to supply due to the lack of technological connection of power receivers to power grid facilities. At the same time, there should be no agreement on the connection of these devices to the power grids in accordance with the OPFRR. On the refusal the supplier must notify the consumer who applied to him. The notice should indicate the reasons for the decision. The notification is sent within 5 days from the date of the client's request. If the application was sent through a network organization, then the notice is sent to it. The notice period is the same - 5 days. The period is calculated from the date of receipt of the application for the conclusion of the contract to the GP.

Participation in the competition

The application must include:

  1. Name of the applicant.
  2. Address.
  3. INN.
  4. State registration number.

The application shall be accompanied by:

  1. An extract from the register of participants of the Wholesale Electric Energy Market with indication of the direction of activity for which the entity trades power and electricity in the market. The document is issued by the market council.
  2. Paper confirming the amount of equity capital, or an agreement to provide a bank guarantee with the amount of coverage equal to the amount of capital required to accept an application for a tender.
  3. Analysis of financial condition (calculation of indicators) for the reporting period preceding the date of filing the application.
  4. Extract from the register of data on bankruptcy. By this document, the applicant confirms that within a year before the filing of the application, no procedures were taken with respect to him regarding the recognition of his insolvency.
  5. Tax, statistical, accounting statements for the previous year and the period preceding the date of sending the application for participation.
  6. Full list of affiliated and interdependent persons.

In addition, the applicant must provide information about the persons entering the applicant in the same group. The form by which this information is provided is approved by the FAS. The document also indicates the characteristics by which persons are members of the relevant group. In addition, information is provided on beneficiaries in whose interests nominal holders hold more than 5% of the applicant's shares. The application specifies the amount of funds that the entity, in case of declaring it a winner, agrees to offer in an offer to be sent to creditors of the replaced GP. This amount is set off against the assignment of claims for the repayment (partial or total) of the debt provided for in para. 12 par. 207 of the OPFRR, in accordance with the requirements specified in para. 1 and 14 of paragraph 207 of the Rules.
