Types of crimes committed out of hooligan motives

For today in the Criminal code of Russia there are only nine kinds of crimes which can be made only because of hooligan motives, therefore it is necessary to consider them more closely, after all all crimes committed on this ground have their own characteristic motive. Hooliganism can be considered a gross violation, which expresses dissatisfaction with the society, while in case of illegal actions, weapons or objects that can cause mutilation can be used. Only the court will be able to establish in the future, exactly how the violation was manifested and what consequences show that the person is truly guilty.

  5. Hooligan actions can be committed not by one person, but by a whole group, such acts can be qualified as collusion.
  6. Hooliganism is also a confrontation with the authorities or their representatives who are in the line of duty.
  7. All crimes directed against the person can be regarded as hooligan motives, in this case the Criminal Code provides for special punishment for each individual case. Any offensive phrases, harm to health and a direct threat to the life of the person, crimes directed against relatives and family members are consequences of such hooliganism, therefore responsibility is foreseen for this.
  8. Hooliganism is vandalism, which takes place against the backdrop of political or ideological dislike. When there is vandalism, then not only the public order is violated, but damage is done to other people's property. In this case, the violator may have to answer for a whole set of different articles.

What is hooliganism?

To date, hooliganism and crimes committed from hooligan motives are just two different concepts. Often such crimes are understood as those aimed at violating the security of society. Such acts can create a real threat that can cost someone a life, or a person can lose property. The difference between these two concepts is that some acts are committed specifically and are a well-thought-out act, and sometimes everything happens by negligence. As punishment for hooliganism, sanctions, fines, and imprisonment for a certain period of time may be applied to the object. As a rule, these crimes are distinguished:

  1. Hooliganism, which is committed at the domestic level with the use of different subjects.
  2. Extremist hooliganism, that is, an offense occurs against the backdrop of hostility on religious, ideological or racial grounds.

  6. Intentional destruction of property or damage.
  7. Intentional deterioration of some important objects that provide vital activity.
  8. Brutal treatment of our lesser brothers.
  9. Hooliganism itself, for example, it can be vandalism.

What is the motive of the crime?

Hooliganism and crimes committed from hooligan motives are carefully studied by specialists. Only after the composition of the crime is analyzed, it will be possible to draw certain conclusions. The fact is that all the crimes listed above are primarily an attack on various generic and specific objects. Very often the corpus delicti is connected with causing harm to health or depriving the object of life, in another case the crime can be committed with the aim of causing damage to property.

Crimes committed from hooligan motives may be of such varieties:

  1. In the first case, crimes can be presented in the form of ordinary assault.

And, of course, this is a confrontation with all the norms that have been adopted in this society. Very often such actions are committed without any reason, just the slightest excuse for the murder to be committed. In court practice, most of these cases are known to occur under the influence of alcoholic beverages. A crime committed out of hooligan motives can be committed on the pretext that a person did not give a cigarette a light or made a remark that seemed offensive to the second party. The most terrible are crimes of hooligan motives, which have caused serious bodily injuries in humans. In this case, the Criminal Code provides for maximum sentences of imprisonment. Most recently, in 2016, amendments to the Criminal Code have been introduced, so now it is considered hooliganism to beating people who are in the circle of relatives and relatives, for example, all relatives, grandparents, grandchildren and children, and also husband and wife. If such violation is repeated, the person who commits hooliganism may be imprisoned for a certain period of time.

Special destruction of property or its damage from hooligan motives

Destruction of property can automatically be regarded as committed from hooligan motives. Legislation deals with such issues:

  1. Acts that led to the fact that the property was damaged or completely destroyed.
  2. The consequences that are the result of wrongful acts.
  3. Motives that led to commit a crime.

Hooliganism and hooligan motivations are different. The fact is that if the property has been completely disposed of and is no longer subject to recovery, it will be regarded as hooliganism, and for this the guilty party will have to answer in full. Most likely, he will be convicted and imprisoned for a certain period. If the property was only damaged and there is every chance to restore it, this can be considered a hooligan motivation. It is worth noting that the deliberate destruction of someone else's property as a result of arson will entail criminal liability. In this case, hooligan motives may have different character. For example, the parties to the conflict may be spouses who could not divide the property among themselves. The party that committed the arson will be responsible for its act. The court will also consider the consequences of such an act in the event that the actions resulted in serious consequences that would be caused by negligence, but at the same time the spoilage of property occurred specifically. Most often, the consequences can be:

  1. As a result of illegal actions, serious harm was caused to human health or several people at once.
  2. The victims were left without housing or have no means of subsistence.
  3. If, due to hooligan motives, the enterprise or the work of the organization was stopped.
  4. If a large number of consumers were disconnected from life support sources, for example, it could be electricity, gas, heat and water supply.

Special deterioration of some important objects that provide vital activity

From hooligan motives can be various destruction, damage or deterioration of various objects that are necessary for life. As a rule, such violations can be punished with a large fine, and if the damage was materially significant, the guilty person may be imprisoned for a period of three years. Hooligan motives and qualification of crimes can have different character, on this basis, punishment will be brought. In some cases, the person who committed such an act may be punished by forced labor.

Brutal treatment of animals as a consequence of hooliganism

Cruelty to animals is a crime. It can also be committed precisely because of hooligan motives. Such hooligan motives will be regarded as a confrontation of morality and the public. It should be remembered that cruel treatment of animals is punishable under the Criminal Code. The court takes into account all the motives, as well as the consequences that resulted from such actions. For example, if an animal has died or been injured as a result of illegal actions, and physical measures have been applied to it, then such an offender will be punished severely. Most likely, he will be imprisoned for several years. Violent treatment can be considered not only the infliction of pain to the animal, but also the deprivation of its food, as well as other means of influence. Such crimes are committed with a certain intent, there are no other reasons for committing. Any person who commits unlawful acts and who is sixteen years old can be brought to trial. To prevent crimes that are committed out of hooligan motives, it is recommended to constantly carry out preventive measures in this direction. It is necessary to conduct social explanatory talks, which can affect all areas of human activities. To do this, it is necessary to actively involve psychologists, educators, social workers and specialists of other industries, for example, narcologists and criminalists. It is necessary to actively develop a network of crisis centers and institutions in which it is quite realistic to receive psychological assistance. Particular attention should be paid specifically to adolescents who are always at risk and are most often such offenders. Special attention must necessarily be given to disadvantaged families. Only in this way will it be possible to reduce the percentage of growth in crimes that are committed precisely because of hooligan motives. If you properly build a system of prevention, then these crimes will be much less, and this is very important for the state and its citizens. All citizens of the state simply must understand that they have equal rights, which means that no one has the right to commit such crimes. Consequently, such offenses will be prosecuted at the legislative level.
